Understanding TDS Compliance for Growing Businesses in India: Sections, Rates & Deadlines

A practical overview of Section 194C, 194J, 194I, monthly challan deposits, and quarterly 26Q return filing obligations.

Tax Deducted at Source (TDS) is a mechanism through which the Indian government collects tax at the point of commercial payment. For businesses, deducting and remitting TDS is a strict statutory duty; non-deduction or non-payment attracts 30% expense disallowance under Section 40(a)(ia) of the Income Tax Act plus mandatory interest.
Core Business TDS Deduction Sections:
  • • Section 194C (Contractors & Sub-contractors): 1% for individual/HUF contractors, 2% for corporate contractors. Threshold: Single bill > ₹30,000 or aggregate annual payments > ₹1,00,000.
  • • Section 194J (Professional & Technical Fees): 10% for professional fees, 2% for technical service fees and call center operations. Threshold: ₹30,000 per financial year.
  • • Section 194I (Rent): 2% on plant and machinery hire; 10% on land, buildings, and commercial office leases. Threshold: ₹2,40,000 per financial year.
  • • Section 194Q (Purchase of Goods): 0.1% on purchase of goods exceeding ₹50 Lakh from a seller, applicable to buyers with turnover > ₹10 Crore.
  • • Section 206AA (Higher Rate Without PAN): If the vendor fails to furnish a valid PAN, the deductor must deduct tax at the higher rate of 20%.
Deposit & Quarterly Return Timeline:
All monthly deductions must be remitted via Challan ITNS 281 on incometax.gov.in by the 7th of the following month (April 30 for March deductions). Quarterly statements (Form 26Q for non-salary, Form 24Q for salaries) must be filed by July 31 (Q1), October 31 (Q2), January 31 (Q3), and May 31 (Q4).
TRACES Certificate Issuance:
Within 15 days of filing your quarterly return, download authentic digitally signed Form 16A certificates from the TRACES portal (tdscpc.gov.in) and distribute them to your vendors.
